{"id":597,"date":"2017-01-11T14:57:12","date_gmt":"2017-01-11T14:57:12","guid":{"rendered":"https:\/\/waterkeeperschesapeake.org\/2017\/01\/11\/regulatory-rollbacks\/"},"modified":"2019-07-22T16:39:19","modified_gmt":"2019-07-22T20:39:19","slug":"regulatory-rollbacks","status":"publish","type":"post","link":"https:\/\/waterkeeperschesapeake.org\/es\/regulatory-rollbacks\/","title":{"rendered":"\u00bfEs esta la forma en que suceder\u00e1n los negocios en DC bajo un nuevo Congreso y un nuevo presidente?"},"content":{"rendered":"<p>&nbsp;<\/p>\n<p style=\"background-image: initial; background-position: initial; background-repeat: initial; background-attachment: initial;\"><span style=\"font-size: 12pt; font-family: arial, helvetica, sans-serif;\"><span style=\"color: #2d2d2d;\">On January 5, 2017, the U.S. House of Representatives passed a <\/span><a style=\"font-size: 1em;\" href=\"https:\/\/www.congress.gov\/bill\/115th-congress\/house-bill\/26\" target=\"_blank\" rel=\"noopener noreferrer\">bill<\/a><span style=\"color: #2d2d2d;\"> that would require congressional approval on all major regulations.\u00a0 Any major regulation that does not get the approval of Congress and the President after 90 days will effectively die.<\/span><\/span><\/p>\n<p style=\"background-image: initial; background-position: initial; background-repeat: initial; background-attachment: initial;\"><span style=\"font-family: arial, helvetica, sans-serif; color: #2d2d2d; font-size: 12pt;\">This is just one of the many \u201cregulatory reform\u201d bills currently before the U.S. Congress. The package of reform bills, taken together, could seriously undermine the current regulatory process \u2013 leaving the public and the environment less protected, while opening the doors for the political system to be subject to more abuse by those with political and economic power. <\/span><\/p>\n<p style=\"background-image: initial; background-position: initial; background-repeat: initial; background-attachment: initial;\"><span style=\"font-size: 12pt; font-family: arial, helvetica, sans-serif;\"><span style=\"color: #2d2d2d;\">Another reform bill \u2013 <\/span><a href=\"https:\/\/www.congress.gov\/bill\/115th-congress\/house-bill\/21\" target=\"_blank\" rel=\"noopener noreferrer\">the Midnight Rules Relief Act<\/a><span style=\"color: #2d2d2d;\"> \u2013 also passed the House in the first week of January.\u00a0 If enacted, this bill would enable Congress to swiftly undo groups of finalized regulations without any consideration for the merits of each regulation.\u00a0 Any group of regulations passed during the last few months in office by a president will be subject to this law. <\/span>GOP leaders said<span style=\"color: #2d2d2d;\"> that their top targets will be President Obama\u2019s rule to decrease the environmental impact of coal mining on nearby streams and his rule to reduce methane emissions. <\/span><\/span><\/p>\n<p style=\"background-image: initial; background-position: initial; background-repeat: initial; background-attachment: initial;\"><span style=\"font-size: 12pt; font-family: arial, helvetica, sans-serif;\"><span style=\"color: #2d2d2d;\">The most sweeping regulatory reform bill \u2013 the <\/span><a href=\"https:\/\/www.congress.gov\/bill\/115th-congress\/house-bill\/5\/actions?q={&quot;search&quot;:[&quot;HR5&quot;]}&amp;r=1\" target=\"_blank\" rel=\"noopener noreferrer\">Regulatory Accountability Act of 2017<\/a><span style=\"color: #2d2d2d;\"> \u2013 will have a dramatic impact on the way federal agencies implement new regulations.\u00a0 This omnibus bill imposes more than 60 new analytical requirements for agencies that are already subject to a robust system of vetting for every new regulation.\u00a0 The bill, among other things, would require agencies to supply exaggerated\u00a0<\/span><span style=\"color: #2d2d2d;\">justification for proposed regulations, add in more checkpoints for parties to delay the whole rulemaking process through evidentiary hearings, expand the scope of judicial review, and override the Supreme Court\u2019s longstanding principle of judicial deference to agencies\u2019 statutory interpretations. <\/span><\/span><\/p>\n<p style=\"background-image: initial; background-position: initial; background-repeat: initial; background-attachment: initial;\"><span style=\"font-family: arial, helvetica, sans-serif; color: #2d2d2d; font-size: 12pt;\">With expanded ability to sue the agency, the bill also stipulates that no \u201chigh-impact rule\u201d will take effect until all judicial challenges to the rule are resolved. With the typical amount of time courts take to resolve these types of lawsuits, this effectively will delay the implementation of such rules for several years.<\/span><\/p>\n<p style=\"background-image: initial; background-position: initial; background-repeat: initial; background-attachment: initial;\"><span style=\"font-family: arial, helvetica, sans-serif; color: #2d2d2d; font-size: 12pt;\">The impact of all these new provisions, taken together, will severely impede the ability of federal agencies to promulgate new regulations.\u00a0 It\u2019s not surprising that some are calling into question the constitutionality of the bill. <\/span><\/p>\n<p style=\"background-image: initial; background-position: initial; background-repeat: initial; background-attachment: initial;\"><span style=\"font-family: arial, helvetica, sans-serif; color: #2d2d2d; font-size: 12pt;\">Waterkeepers Chesapeake are following these bills.
